By accessing or using our services, including Rello, Home Ready, Home Stretch, Market Intel, and any related applications or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and Hero Training, LLC ("Hero Training," "we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Services constitutes acceptance of any changes.
Hero Training provides software-as-a-service (SaaS) solutions designed for real estate professionals, including mortgage loan officers, real estate brokers, and agents. Our Services include:
To use certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
You must be at least 18 years old and capable of forming a binding contract to use our Services. By using our Services, you represent and warrant that you meet these requirements.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes.

You retain ownership of any content, data, or information you upload, submit, or transmit through the Services ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely for the purpose of providing and improving the Services.
We take data protection seriously. Please review our Privacy Policy for information about how we collect, use, and protect your data.
While we implement reasonable measures to protect your data, you are responsible for maintaining your own backups of User Content. We are not liable for any loss or corruption of User Content.
Certain features of the Services require payment of fees. You agree to pay all applicable fees as described on our website or in your service agreement. All fees are non-refundable except as expressly stated otherwise.
For subscription services, you authorize us to charge your designated payment method on a recurring basis according to your selected billing cycle. You are responsible for keeping your payment information current.
We reserve the right to change our pricing at any time. For existing subscribers, price changes will take effect at the start of the next billing cycle following notice of the change.
The Services and all related content, features, and functionality (including but not limited to software, text, graphics, logos, and trademarks) are owned by Hero Training or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or other brand features without our prior written consent.
The Services may integrate with or contain links to third-party websites, applications, or services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERO TRAINING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Hero Training and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
You may terminate your account at any time by contacting us at [email protected] or through the account settings in the Services.
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.
Upon termination, we may delete your User Content and account information. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of such courts.
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Hero Training regarding the Services.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
This section applies to Hero Training's SMS/text messaging program and constitutes our Mobile Terms of Service.
Hero Training offers an optional SMS/text messaging program that allows users to receive marketing communications, product updates, tips, special offers, and promotional messages. By opting in to our SMS program, you agree to receive recurring automated marketing text messages from Hero Training at the mobile phone number you provided.
You may opt in to receive SMS messages from Hero Training by completing our Communication Preferences form and checking the SMS consent checkbox. Your consent is entirely voluntary. Consent to receive SMS messages is not a condition of purchasing any goods or services from Hero Training.
Message frequency varies. You may receive up to 4 SMS messages per month from Hero Training. Message frequency may vary based on your interactions with our Services and active promotional campaigns.
Message and data rates may apply. Standard messaging rates from your wireless carrier may apply to messages you send or receive. Please contact your wireless carrier for details about your messaging plan. Hero Training is not responsible for any charges from your wireless carrier.
You may opt out of receiving SMS messages at any time by:
After opting out, you will receive a final confirmation message. You will no longer receive marketing SMS messages from Hero Training unless you opt in again.

Our SMS program is supported by major U.S. wireless carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Coverage is not guaranteed in all areas. Carriers are not liable for delayed or undelivered messages.
Your phone number and SMS consent information are subject to our Privacy Policy. We do not sell or share your phone number with third parties for their marketing purposes.
